1. Introduction
These Terms and Conditions ("Terms") govern your use of the Amandla Meters platform ("Platform"), operated by Amandla Meters (Pty) Ltd ("we", "us", "our"). By creating an account, you agree to be bound by these Terms.
2. Definitions
- "OTA Delivery" — Over-the-air delivery of prepaid electricity credits directly to your smart meter without a physical token.
- "Wallet" — A stored-value account on the Platform used to purchase electricity.
- "Smart Meter" — A two-way communication electricity meter registered on the Platform.
- "Service" — Prepaid electricity purchasing, OTA delivery, wallet management, and related features provided through the Platform.
3. Eligibility
You must be at least 18 years old and a resident of South Africa with a valid SA mobile number to use the Platform. You must have lawful access to the smart meter(s) you register.
4. Account Registration
- You must provide accurate and complete information during registration.
- You are responsible for maintaining the confidentiality of your password and MFA credentials.
- You must notify us immediately of any unauthorised use of your account.
- One account per mobile number. Duplicate accounts may be merged or suspended.
5. Payments & Fees
- Electricity purchases are processed via third-party payment providers (Stitch, PayFast).
- A convenience fee of R1.50 applies per bank transaction. Wallet payments incur no fees.
- Payment provider fees (approximately 1% for instant EFT, 3.5% + R2 for card) are displayed before confirmation.
- All prices include VAT where applicable.
- Subscription tiers (Free, Plus, Pro, Business) are billed monthly from your wallet. See the Pricing page for details.
6. Wallet
- Wallet funds are non-interest-bearing and held for the sole purpose of purchasing electricity.
- Minimum wallet top-up is R10.
- Wallet balances are not transferable between accounts.
- Refunds for failed OTA deliveries are automatically credited to your wallet.
7. OTA Delivery
- OTA delivery depends on meter connectivity and manufacturer API availability.
- We make reasonable efforts to deliver credits promptly but do not guarantee delivery times.
- Failed deliveries are retried up to 3 times. If all retries fail, wallet payments are automatically refunded.
- We are not liable for delivery failures caused by meter hardware faults, power outages, or network issues beyond our control.
8. Auto Top-up
If enabled, the Platform will automatically purchase electricity from your wallet when your meter balance falls below your configured threshold. You may disable auto top-up at any time. Auto top-up will not execute if your wallet balance is insufficient.
9. Referral Programme
- Referral rewards (R10 per successful referral) are credited to both parties' wallets upon the referred user's first purchase.
- We reserve the right to modify or discontinue the referral programme at any time.
- Abuse of the referral system (fake accounts, self-referrals) will result in account suspension.
10. Data Protection (POPIA)
- We process your personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA).
- Personal data collected includes: name, phone number, email address, meter numbers, payment history, and usage data.
- Your data is stored in South Africa (AWS af-south-1, Cape Town) to comply with POPIA data residency requirements.
- Email addresses and sensitive fields are encrypted at rest using AES-256-GCM.
- We retain transaction records for 5 years as required by financial regulations.
- You may request access to, correction of, or deletion of your personal data by contacting support.
- You may withdraw consent for data processing at any time, which will result in account deactivation.
11. Security
- All accounts are protected by multi-factor authentication (SMS, email, or authenticator app).
- Passwords must meet PCI-DSS 4.0 complexity requirements (minimum 12 characters, mixed case, numbers, special characters).
- We employ WAF protection, encryption at rest and in transit, and continuous security monitoring.
- We will never ask for your password, OTP, or payment details via phone, email, or WhatsApp.
12. WhatsApp & USSD Services
- Electricity purchases via WhatsApp and USSD are subject to the same terms as web/mobile purchases.
- Standard mobile data or airtime charges from your network provider may apply.
13. Prohibited Conduct
You may not:
- Register meters you do not have lawful access to.
- Attempt to tamper with, bypass, or reverse-engineer the Platform.
- Use the Platform for money laundering or fraudulent activity.
- Create multiple accounts to abuse referral rewards or free-tier limits.
- Resell electricity credits purchased through the Platform.
14. Limitation of Liability
- The Platform is provided "as is". We do not warrant uninterrupted or error-free service.
- Our total liability for any claim shall not exceed the amount you paid through the Platform in the preceding 12 months.
- We are not liable for losses arising from meter hardware failures, power utility outages, payment provider downtime, or force majeure events.
15. Suspension & Termination
- We may suspend or terminate your account for breach of these Terms, suspected fraud, or regulatory requirements.
- You may close your account at any time. Remaining wallet balance will be refunded to your original payment method within 30 business days.
- Transaction history is retained for 5 years after account closure for audit and regulatory compliance.
16. Dispute Resolution
Any disputes shall be governed by the laws of the Republic of South Africa. Disputes will first be addressed through our support system. If unresolved, disputes may be referred to the relevant consumer tribunal or arbitration in accordance with the Consumer Protection Act, 2008.
17. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email, push notification, or in-app notice at least 14 days before taking effect. Continued use of the Platform after changes constitutes acceptance.
